How to avoid garden disputes with your tenants

Gardens have always been a mixed blessing for landlords, they are currently popular with tenants, but there are management and maintenance issues.

Now, a garden consulting company called Paving Direct has put forward some suggestions to try to reconcile the two aspects of this problem.

Generally, the tenant is responsible for keeping the garden in the state it was in when the lease began.

The landlord is responsible for tasks that require additional expertise-such as repairing broken fences, removing broken sheds…

In order to determine how landlords can avoid garden disputes, Paving Direct has offered five tips:

Put clear garden maintenance clauses in place – The tenant should know what they are responsible for in the garden and this should be written in the tenancy agreement which both parties have signed.

Ensure that the garden is in good condition before the tenants move in – This will set the ground running for new tenants and ensure they have a baseline of what is expected from them.

Keep a record of the garden inventory – Landlords should keep reports and photos of the garden so they have documentation in case of any problems which may arise with the tenant.

Conduct regular inspections – If there are any apparent issues, the tenant should be asked to rectify these at the time of inspection.

Maintain a good relationship – Keeping a good relationship with tenants can help to avoid a garden dispute. Tenants should also be encouraged to report issues when they happen, at the end of the tenancy it may become difficult to decide who owns responsibility over the issue.
